Payne v. Tennessee Essay

Facts: After spending a morning and afternoon drinking beer and injecting cocaine, Pervis Tyrone Payne entered the apartment of 28-year-old Charisse Christopher and her two children, Lacie, age two and Nicholas, age three at approximately 3:00 p.m. on June 27th, 1987. Payne made sexual advances toward Charisse Christopher. She resisted, which lead Payne to kill both Charisse and Lacie. Nicholas was found with several severe stab wounds that completely penetrated him front to back, but he managed to survive. Payne was apprehended later that day hiding in the attic of a former girlfriend’s house. Payne was convicted by a jury of two counts of murder. At sentencing, Payne presented the testimony of his mother, father, Bobbie Thomas and a clinical psychologist. These testimonies’ showed Payne was of good character, he attended church and he was of low intelligence and mentally handicapped. The State presented the testimony of Ms. Christopher’s mother, who spoke of the negative impact of the murders on Nicholas. Furthermore, the prosecutor presented argument regarding Nicholas’ experience. The jury sentenced the Payne to death on each count of murder. History: Pervis Tyrone Payne was arrested and charged with two counts of first-degree murder, the jury sentenced Payne to death on each count of murder. Issue: Does the Eighth Amendment prohibit a capital sentencing jury from considering â€Å"victim impact† evidence relating to the personal characteristics of the victim and the emotional impact of the crimes on the victim’s family? Finding: No. Victim impact evidence shall not be considered according to the United States Supreme Court. This rule was because victim impact evidence presents factors about which the defendant may have been unaware of and therefore, the evidence has nothing to do with the â€Å"blameworthiness† of a particular defendant. So basically, no evidence outside the case and not relating directly to the circumstances of the crime was admitted. In the present case, however, the Supreme Court expressed the view that â€Å"a State may properly conclude that for the jury to assess meaningfully the defendant’s moral culpability and blameworthiness, it should have before it at the sentencing phase evidence of the specific harm caused by the defendant.† So, a State may permit the admission of victim  impact evidence, as the Eighth Amendment presents no per se bar. The Supreme Court of Tennessee affirmed the conviction and sentence. The court rejected Payne’s contention that the admission of the grandmother’s testimony and the State’s closing argument constituted prejudicial violations of his rights under the Eighth Amendment as applied in Booth v. Maryland, 482 U.S. 496 (1987), and South Carolina v. Gathers, 490 U.S. 805 (1989). Rational: The court stated â€Å"Stare decisis is not an inexorable command; rather, ‘it is a principle of policy and not a mechanical formula of adherence to the latest decision.’† So basically, not all laws are set completely in stone and it can change over time from case to case. The court states that neither the law nor the facts supporting the prior cases have changed, merely the personnel of the Supreme Court have changed. My Notes: A few things I noticed was I unclear how Payne could argue that introducing such evidence as the grandmother testimony encourages jurors to decide for the death penalty based on emotions rather than reason. But, having his parents testify that he was of good character as plays on emotion, rather than reason. To me, only after introducing victim impact evidence can the juries meaningfully determine the proper punishment. After all the whole reason for this is to protect the victim right?

Women had to live up to an ideal created by men. This meant women had to appear less intelligent than their husbands, women had to be well mannered, and modest in behaviour and speech. Women from richer middle and upper class families had servants to look after their homes and weren't expected to work. Upper class women were brought up and educated to be a dutiful wife. Lower class women had to look after their husband, manage everything in the house as well as finance, be utterly faithful to her husband and willingly manage a large family Some women did go to work; in 1901 55% of single women and 14% of married women were at work. In 1914 the largest employer of women was the Domestic Service with 1,600,000 this is because the Domestic Service was regarded as better than working in factories. About 656,000 women worked in the factories of the textile industry – especially the cotton mills of northern England. Lots of women were in work but many of them hardly made enough money to live on. Married working class women faced a lot of problems. Families were large: 71% of women had four or more children and 41% had seven or more. Many women however lost children to diseases like Scarlet Fever, Diphtheria, and Tubercular. Children died because they didn't have any health care and doctors were expensive and hard to find. Poverty, bad housing and child bearing affected the health of working class women probably because they put the health of their husbands first as they had to be at work to earn money. Lots of women wanted the vote before the Great War. Suffragists wanted the vote and played by the law where as Suffragettes were more militant. The Suffragettes committed many acts of violence such as destruction of property and arson. Lots of people were against giving women the right to vote, even queen Victoria was. This meant women's suffrage had to gain support, so they continued with their marches and put posters up to try to gain support. The government passed a cat and mouse act which allowed Suffragettes to be released when they became ill because of their hunger strike and as soon as they were better again they were arrested and sent back to prison to finish their sentence. The outbreak of the First World War brought an end to the Suffragettes campaign.

On the walls, there were different charts, which had different kinds of drawings, some of which had been made by the children. The charts had alphabets, and drawings that represented every word. For instance, in a letter ‘C’ there was a large cat that was drawn to make it easy for the children to understand. The class had large tables with chairs where the child ren were supposed to sit. However, there was a large space in the classroom, which had been left for a purpose. At one corner of the classroom, there was a television set which is use sometimes by the teachers to pass important information to the children. Windows are higher to ensure that children are not distracted. The design of the classroom indicates that safety measures have been taken to protect the children against any form of harm. The pupils In this particular study, I sampled out two pupils that I would use in making observations. They were Jane and James. The pupils observed were between 3-4 years of age. They were jovial as they went on with their activities in school. One of the most striking features is that the pupils came from different sociocultural backgrounds. The class had full representation of different cultures. On the other hand, the class was designed in a way that it would allow children with special needs to be included. The class had two children who wer e physically challenged. They were however able to appreciate learning just like any other normal children. The Story of an Hour by Kate Chopin Essay The Story of an Hour written by Kate Chopin in 1894 the reader should zone in on the main character Mrs. Mallards thoughts and not so much on the excitement of the story but the ending. The insights of different literary elements such as the point of view and tone make this short story omniscient and subtle yet cruel that all contribute to the multiple themes. According to Journey Into Literature, a theme is an idea, or message, that lies behind a literary work, the theme tells what the story is about: What is the underlying message? What is driving the action? (Clugston, 2014). When answering any of these questions, the main theme deals with a dysfunctional marriage and other minor themes including communication, freedom and confinement, time, and mortality. The reason for the dysfunctional marriage comes from males dominating the women of the 19th century and how they were prisoners to their husbands. Women were expected to stay home to cook, clean, and take care of the children. The woman was only a mean of a mans pleasure and reproduction. She had no rights, no opinions, no sentiments no emotions (Radek, 2001). If they did work and it was not too often and the pay and job was always less compared to a man. There was no mention of true love since marriage was out of convenience, monetary comfort and status during that era. Communication is essential and its delivery because when Mrs. Mallard was told of her husbands untimely  death on a train and then to find out that he was not dead after all, was more deadly than how you tell it versus what actually happened. Be careful with delicacy and preparation when delivering a message to a sick listener with a heart condition or it can cause further damage. Freedom and confinement deals with how she was suppressed in marriage, having a bad heart, confined to home and suddenly given freedom of it all by her husband passing and just as the freedom was given to her it was taken away with seeing her husband alive. It was all about feeling the joy of freedom which was yanked from her upon reaching of the husband healthy and alive (Jamil, 2009). Time in this story happens so fast by changing things drastically and dramatically in under a hour. Mrs. Mallard only had less than a hour to process the news of husband passing. In that time she thought of grief and moved quickly into what life by herself would be like. Once seeing the supposedly dead husband alive, just shattered her new images and dreams of a new life. Last there is the mortality which is powerful and told the wrong way will deliver a lethal dosage. Finding out that a person died can be horrific but discovering that it is not true could be worst. The tables turned so soon on Mrs. Mallards complex, emotional reaction that it caused her death instead. The final thought of her freedom from the marriage being taken away was too much for her to handle. One of the literary elements that contributed to the themes was the point of view. There was the use of omniscient third-person so the reader got to understanding of the story by more than just the main character. This was great since to have different views of what or how things were explained throughout the story. The omniscient third-person narrative voice of understanding, compassionate, freeing made it easier to deal with Mrs. Mallards behavior and thoughts with at least sensible reasoning. For example, There was something coming to her and she was waiting for it, fearfully. What was it? She did not know; it was too subtle and elusive to name. But she felt it, creeping out of the sky, reaching toward her through the sounds, the scents, the color that filled the air. (9) Even though Mrs. Mallard was not forced into her dysfunctional marriage, the way out was not so nice, but the feelings she had were chasing her down. Mrs. Mallard has finally free after her husbands death and freedom was scary along with  being exciting altogether. Because this was written in third person, the thought of her being sort of selfish, uncaring or most of all not in love with her husband would have made the story much different to swallow. The second literary term to contribute with the flow of the themes was through the tone. In this story the description of Mrs. Mallard in a lifetime of emotional torment, dawning comprehension. liberating, that ended in ironic detachment. Mrs. Mallard brushes off the idea of love and marriage for the wonderful and glorious idea of at last freedom. The other characters around her such as her sister Josephine and Richards which is the husbands friend though she was crying her eyes out over the death of her husband and she was actually relieved to be a free woman. At the end, it was understood that she died from sudden shock of seeing her supposedly dead husband alive after all joy that kills (23). The only piece of the puzzle that is left unanswered for sure is what really killed her and the narrator left that up to the reader to decide. In conclusion, in order for a short story to be successful there must be well organized literary elements to support the theme. Analysis Of The Ryanair Business Strategy Business Essay Business strategy is an essential component to a firms business model and is a vital player in aiding the firm drive itself to achieve its mission. Through a clear business strategy a firm can derive its position in the long term and create a competitive advantage in the market for itself. In this essay we explore the business model of Ryanair and assess their strategy. Ryanair is an Irish low cost airline headquartered in Dublin founded in 1985. It operates 181 aircrafts over 729 routes across Europe and North Africa from 31 bases. Ryanair has seen large success over the recent years due to its low-cost business model and has become the worlds largest airline in terms of international passenger numbers. Taking Porters generic business strategies into consideration, Ryanair operates a cost-leadership strategy to drive itself into achieving its mission of being the leading European low-cost carrier (LCC). Throughout this essay the business strategy of Ryanair will be analysed and the sustainability of their model evaluated. Ryanairs objective is to firmly establish itself as Europes leading low-fares scheduled passenger airline through continued improvements and expanded offerings of its low-fares service (Ryanair). Considering their objectives and mission, Ryanairs decision on their cost-leadership strategy was based on a few main factors which are discussed below. A major influence was the deregulation of the airline industry in 1978 which removed government intervention within the European continent. Under the new rules, routes and fare decisions were made by individual airlines which meant that they could compete on other factors besides food, cabin crew and frequency. As a result of deregulation, a large number of new airline start-ups emerged within the EU and competition among airlines increased dramatically resulting in downward price pressures. Ryanair was established to take full advantage of these market conditions. By offering low prices, Ryanair entered a huge and virtually unlimited market. Having seen the major success of the low cost carrier Southwest in the United States, Ryanair decided to follow in their footsteps by establishing a LCC for the European continent that targeted fare conscious leisure travellers and regular low cost business travellers. By doing this Ryanair became the first low-fare airline in Europe. However, they took the Southwest model further by offering no drinks and snacks at all and abolishing the frequent flyer program which Southwest up to this day offers its customers (Boesch 2007). The evaluation of Porters five forces influenced Ryanairs choice of a cost-leadership strategy, as the threat presented by new entrants and the threat of substitutes could hinder their success. The threat of new entrants is high within the aviation industry which meant that low fares would help drive away any further competition. The threat of substitutes to Ryanair had to also be carefully examined. Their primary market, Europe, had the availability of high speed trains and car holidays. For Ryanair to be successful, prices had to be low to attract the public, and resist strong competition from substitutes like Eurostar. As Europes largest low fare airline, Ryanairs competitive advantage remains in their ability to continue as cost leaders; providing the cheapest fares to its customers. This dictates that the company must minimise its own costs to ensure that they are able to offer customers the service at a price below their direct competitors. This leads us to consider some key functional strategies which directly help Ryanair towards their ultimate goal to be Europes leading low fares airline (Ryanair). The marketing strategy is perhaps the most obvious and significant functional strategy of Ryanair. Low fares are designed to stimulate demand, attracting fare-conscious travellers, those who may have used alternative forms of transportation or even those who may have not travelled at all. Penetration pricing as it is called helps gain market share and simply, more customers equals more revenue (Wheelen Hunger 2006). Tickets are almost solely sold on their website www.ryanair.com which very importantly keeps sales costs to a minimum since very few phone operators are employed and computers are able to cheaply handle all functions of sales. Logistics strategy deals with the flow of products into and out of Ryanair. Again there is heavy emphasis on cost saving and reducing measures. Ryanair fly to secondary airports which are potentially much further from the City centre but accessible enough by other forms of ground transportation. At these airports Ryanair are able to negotiate extremely aggressively and demand the lowest landing and handling fees. Additionally Ryanair is usually able to gain financial assistance with marketing and promotional campaigns at these airports. Ryanairs strategy when purchasing aircraft is to buy new, uniform aircraft. This is beneficial for a number of reasons all of which directly help cost saving measures. Firstly, by being able to order same aircraft in bulk they are able to negotiate a better price per aircraft. Secondly, uniform aircraft mean that there are potential savings in staff training; air stewards being more familiar with all aircraft and maintenance will be simpler. Finally by buying new, the company has safer, more fuel efficient planes with lower maintenance costs. Safer aircraft also means greater consumer confidence, equating to more fare sales. Furthermore Ryanair aggressively hedge and fix as many of their costs as possible, such as oil and aircraft prices so they are not subject to future price fluctuations which could adversely affect profitability (Stone 2008). The human resource policy is again directly related to reducing costs. Employees are expected to pay for their own uniform and equipment. Training given is the required minimum and staff utilisation is among the highest in the airline industry. Many staff are employed on performance contracts and those who do not meet their expectations are readily replaced. Staff are also expected to take on a number of roles, cabin staff will also clean the aircraft prior to the next service, check in staff assist in boarding the aircraft etc. Ryanair has successfully experienced years of growth both in the number of its aircrafts and passengers since its launch.   However, with the global financial system recently suffering its greatest crisis in more than 70 years, existing business models of many aviation firms are coming under great strain. As this economic downturn bankrupts LCCs like XL and Zoom with more expected to follow, the question is whether Ryanairs cost-leadership strategy is sustainable or not as it continues to offer lower fares in the face of high costs. Although Ryanair has posted losses along with other aviation firms for the latest quarter, it is expected to emerge from this downturn with fewer competitors because its à ¢Ã¢â‚¬Å¡Ã‚ ¬1.8 billon balance sheet is one of the strongest in the industry. Additionally, as the credit crunch takes its toll, traditional airlines are not in a position to cut fares and the threat of new LCCs is virtually eliminated due to the lack of financing. Although Ryanair f aces competition from substitutes like Eurostar, it is at an advantage because of Eurostars limited destinations.   Ryanair is sticking to its mantra, when the going gets tough, sell more seats for almost nothing (Symonds 2008). By offering low fares, Ryanair expects passengers to trade down to the low cost airlines rather than stop flying completely. This trend appears accurate so far based on passenger numbers as recession forces millions of passengers to focus on price (Waterman 2009). Additionally, the latest statistics from The European Low Fares Airline Association members show a 15.7% year-on-year growth in the number of passengers for 2008, indicating that the LCC model is robust, even in times of crisis (Latest 2009). Consequently, there is no doubt that Ryanair looks poised for substantial profits and passenger growth in the coming years. However, in order to compete with other LCCs and maintain its continued market share growth in the future, Ryanair needs to improve its poor customer relations. The sustainability of Ryanairs cost leadership strategy also depends largely on the price of oil and how effective the firm is in cutting costs in order to continue offering low fares. According to the firms latest financial report, Ryanair will enjoy significantly lower oil costs thanks to their recent hedging programme, when most of their competitors are already hedged at much higher prices. These lower prices will drive Ryanairs traffic growth, maintain high load factors and capture market share from higher cost fuel surcharging competitors (3rd Quarter Results 2009). In order to cut costs, Ryanair plans to close all its airport check-in desks by the end of 2009 and have passengers check-in online instead. Other cost saving methods not yet implemented include charging customers for using toilets on airplanes (Lalor 2009). These cost cutting ideas are not very popular among consumers and it means that Ryanair needs to improve its already tarnished brand image in the future which it had attained through negative press reporting and misleading advertisements. The current strategy at Ryanair is expected to work so well that despite the recession Ryanairs CEO has underlined the firms commitment to expansion. The firm is expected to grow at 20 percent a year because of a 180 aircrafts on order from Boeing. These expansion plans for the future will require the company to increase its landing slots at airports and recruit more employees. Currently Ryanair has limited access to landing slots in major airports and the secondary airports are long distances away from city centres which could make it less attractive in the future.   However, a remarkable cut in flights by other European airline carriers due to recession is creating enormous opportunities for Ryanair, as many major airports compete to reduce charges in order to attract Ryanairs growth (3rd Quarter Results 2009). Availability of skilled personnel shouldnt be a problem for Ryanair due to recent high unemployment levels. However, Ryanair needs to improve its current low level of empa thy for employees if it is to retain them in the future. Even though Ryanairs cost leadership strategy is robust and it looks set to serve them well in the future, there are some key areas within the business that can be improved on to enhance the firms profitability and brand image. Ryanair has always been criticised for many aspects of its poor customer relations. According to The Economist, Ryanairs cavalier treatment of passengers had given Ryanair a deserved reputation for nastiness and that the airline has become a byword for appalling customer service   and jeering rudeness towards anyone or anything that gets in its way (Aviation 2007). If Ryanair is to maintain its large customer base, it needs to ensure that it acknowledges its customers concerns and maintains a service focused attitude at all costs. Ryanair needs to invest in servicing customers better by providing a non-premium contact number, improving its non user friendly website, and simplifying the terms and conditions of the flight service. Ryanair should also create a frequent flyer program to establish a fixed customer base and encourage customer loyalty. Ryanair is notorious for its high staff turnover which negatively affects its reputation as an employer. Over utilization of employees, poor remuneration package, and minimal training are a few other critical items to be considered by Ryanair if it is to retain employees in the future. Ryanair needs to understand that although it is currently possible to replace outgoing employees, but with time Ryanairs overall image will be tarnished. Resultantly, attracting new employees could become impossible and this will hinder their expansion plans. Ryanair should incorporate a flexible benefits package solely designed to improve employee morale such as flexible working hours and extra holidays. To improve its image amongst employees, training at all employee levels must include exposure to similar techniques and methods that help promote the development of a uniform company identity. Following huge success in Europe, Ryanair should consider introducing low cost transatlantic flights to support its expansion plans and attain a larger customer base. With a high demand for certain routes like London-New York and room for negotiation in airplane prices and airport slots mainly due to the current financial climate, it is an ideal time to further reap the rewards of the cost leadership strategy that has served Ryanair so well over the years. Ryanairs model looks set to survive the current industrial downturn through its lower costs and substantial cash balances. No airline is better placed in Europe than Ryanair to trade through this downturn. It will therefore continue to grow, by lowering fares, taking market share from competitors, and expanding in markets where competitors either withdraw capacity or go bust (Monaghan 2008). The organization with the help of this model can identify potential threats and develop a picture as what can happen in the near future and how to cope up with the challenges in the best possible manner (Kotters 8-Step Change Model, 2010). Develop a strong coalition: The organization in order to bring change should develop a team of effective leaders, which can develop team building and identify the weak areas so that a strong mix of people is developed within the company. Develop a vision for change: McDonalds should develop a vision that identifies a value, which is central to change. It should implement the vision in an effective manner so that the company can achieve its strategic objectives. Communicating the vision: After creating a vision, the management should communicate the vision to all the levels of management so that the workforce can work accordingly and always has an edge over its competitors. Eliminate obstacles: If McDonalds follows the above given steps properly, the changes can take place in the organization without any problems. Critical Analysis: Change management plan plays an important role in the organization and the tools and techniques applied above will give the company a competitive edge against its rivals. The force field analysis, if applied in the company, will help in knowing its driving forces as well as those forces, which are acting against it. On the other hand, the disadvantage of this factor will be that implementing this analysis can be costly and its success can also not be guaranteed in the long run (Fiske, Gilbert and Lindzey, 2010). Other than this, the Kurt Lewin model for change management can bring various improvements in the working of the employees as well as give an idea where the organization is actually standing and what measures it can take to cope up with the problem. It also proves to be an effective method of improving decision making ability of the employees. However, applying this method can be a drawback as this method depends more on theoretical approach than on a practical one. It totally depends on the skills and capabilities of the individual carrying out the work. Finally, Kotters eight step methods will help in knowing every minute detail of the company in the best possible manner, but for this approach to be implemented in the company there will be a requirement of additional cost and time for the management. They will have to understand every step properly, as the wrong implementation of one step can result in the whole plan going in disarray (Sofo, 2000).
